Three Strikes Policy

Under these policies, we assert safe harbor protection from liability related to alleged copyright infringements committed by third parties. By implementing and enforcing these policies, we make a sincere effort to identify users or account holders who may engage in repeated copyright infringement. Consequently, we may, in appropriate circumstances, ban the accounts of users who we believe, at our sole discretion, are repeat copyright infringers, thus preventing them from uploading new content. This is in line with our voluntary compliance with laws like the DMCA and CMA.
Our “Three Strikes” repeat infringement policy is executed as follows: After receiving notice of a first infringement, uploaders are granted two additional chances to cease uploading videos or other content that infringes upon third-party copyrights. This means that if an uploader has three videos removed following the first notice, they will not be immediately banned from TubeGBT. Instead, they will be given an opportunity to adjust their behavior, and this will be considered as a single strike, not three. Each notice in a day is treated as a separate notice for the purpose of repeat infringement, regardless of the number of notices contained in a given notification. Banning a user immediately would provide little educational value in our approach to repeat infringers. However, in specific circumstances, at our sole discretion, we may ban and delete a user after a single notice or two. We run a check for repeat infringers approximately every 24 hours.
By using our website, you acknowledge and agree to our policy. You will be considered a repeat copyright infringer when we receive three or more notices of alleged infringement that meet the following criteria:
- The notices are directed toward materials you have submitted for publication on the website (excluding items stored in your private locker accessible only by you on your own devices).
- The notices do not pertain to what we reasonably consider to be “fair use” of copyrightable material, as determined within our discretion.
- You fail, within seventy-two (72) hours after we forward the notice to you, to provide a proper counter-notice that fully complies with the requirements outlined in Section 10 of our Terms of Use.
